B.O.M. Fitness / Blue Ocean Molecular ("B.O.M.", "we", "our", or "us") respects the privacy of clients, applicants, website visitors, and portal users. This Privacy Policy explains how we collect, use, store, and protect information when you visit our website, submit an inquiry, use the B.O.M. Portal, communicate with us, or participate in B.O.M. coaching services.

B.O.M. provides fitness coaching, exercise programming, general nutrition education, habit coaching, accountability, performance tracking, and related wellness services. B.O.M. is not a medical provider and does not provide medical diagnosis, medical treatment, medical nutrition therapy, physical therapy, psychotherapy, medication management, hormone management, or medical clearance.

1. Information We Collect

We may collect information directly from you, through the website or portal, through approved integrations, or through communications you choose to send to us.

Inquiry and Contact Information

When you submit an inquiry, request a consult, join a waitlist, or contact us, we may collect your name, email address, phone number, coaching interest, goals, availability, and any details you choose to provide.

Account and Portal Information

If you become a client or portal user, we may collect account information such as your name, email address, phone number, date of birth, login/account details, emergency contact information, program/tier, coach notes, onboarding forms, consents, agreements, and administrative records.

Training, Performance, and Progress Information

Coaching and portal use may involve training logs, completed workouts, exercises, sets, reps, loads, cardio activity, progress notes, check-ins, bodyweight, measurements, progress photos, body composition information, adherence data, after-action reports, progression recommendations, and related performance data.

Nutrition, Habit, and Lifestyle Information

Depending on the service, we may collect nutrition targets, food logs, macros, hydration, meal notes, habits, sleep notes, stress notes, recovery feedback, and other lifestyle information you choose to share for coaching context.

Wearable and WHOOP Data

Designated B.O.M. coaching tiers may require an active WHOOP device and subscription. If you connect WHOOP or share wearable data with B.O.M., we may collect or receive available wearable metrics such as sleep, recovery, strain, workout data, heart rate, resting heart rate, heart rate variability (HRV), respiratory rate, skin temperature, blood oxygen/SpO2, calories or energy estimates, activity metadata, subjective tags, habit inputs, and related metrics made available by WHOOP or another wearable provider.

Wearable data may be collected through the B.O.M. Portal, an approved API/OAuth integration, screenshots, exports, client-provided reports, manual entries, or another approved method.

Bloodwork, Lab Results, and Health-Related Information

Designated B.O.M. coaching tiers may require baseline bloodwork, such as the Marek Diagnostics Total Health Panel - Comprehensive or another B.O.M.-approved equivalent panel. If you provide bloodwork results or related health information to B.O.M., we may collect lab PDFs, screenshots, biomarker values, lab notes, medical restrictions, provider notes provided by you, medication/supplement information you choose to disclose, and related communications.

Bloodwork may be submitted through email, secure upload link, encrypted file transfer, client-provided PDF, screenshot, portal entry, or another approved electronic communication method. Do not send bloodwork or sensitive health information unless you have signed the required B.O.M. consent forms and understand the risks of electronic communication.

Communications

We may collect communications exchanged with you through email, portal messages, text messages, forms, scheduling tools, calls, consult notes, support requests, and other client communications.

Payment and Transaction Information

Payments may be processed through third-party payment processors. B.O.M. may receive limited transaction information such as payment status, amount paid, invoice history, subscription status, and billing contact details. We do not intentionally store full credit card numbers on our website or portal.

Website, Device, and Technical Information

When you use our website or portal, we may collect technical information such as IP address, browser type, device type, pages visited, referral source, timestamps, cookies, local storage, analytics data, login activity, security logs, and other information needed to operate, secure, and improve the website and portal.

2. How We Use Information

We may use information to:

  • respond to inquiries and consult requests;
  • evaluate coaching fit and program eligibility;
  • onboard clients and operate coaching services;
  • create, deliver, and adjust training programs;
  • review completed workouts and training progression;
  • provide general nutrition education and habit coaching;
  • review wearable, recovery, and performance data;
  • generate check-ins, progress reports, and after-action reports;
  • support safety screening and referral awareness;
  • communicate with clients;
  • operate, maintain, secure, and improve the B.O.M. Portal;
  • process payments, invoices, and administrative records;
  • enforce agreements, policies, and program requirements;
  • comply with legal, tax, accounting, security, and business obligations;
  • protect against fraud, misuse, unauthorized access, or security incidents;
  • improve services using de-identified, aggregated, or limited information where appropriate.

3. Bloodwork and Lab Results

B.O.M. may require certain clients to complete baseline bloodwork and provide the results to B.O.M. as part of designated coaching tiers. Bloodwork is used only as general fitness, wellness, performance, recovery, and coaching context.

B.O.M. does not diagnose, treat, prescribe, interpret disease, manage medications, manage hormones, provide medical nutrition therapy, or provide medical clearance based on lab results.

Clients are responsible for reviewing bloodwork results with a licensed physician, qualified healthcare provider, or appropriate lab review service before relying on results for health, medication, supplement, treatment, or medical decisions. If results are abnormal, outside the reference range, concerning, related to symptoms, or related to a known medical condition or medication, B.O.M. may require medical clearance before beginning or continuing training.

4. WHOOP and Wearable Data

Designated B.O.M. coaching tiers may require an active WHOOP device and subscription. If you connect WHOOP or share wearable data with B.O.M., you authorize B.O.M. to use that data for coaching, programming, recovery review, workload decisions, accountability, progress tracking, and after-action reports.

Wearable data is not medical diagnosis. It may be inaccurate, incomplete, delayed, or unavailable. B.O.M. uses wearable data as one input alongside training performance, subjective feedback, recovery, sleep, stress, pain, symptoms, nutrition, and coaching judgment.

You may revoke wearable data access by disconnecting the integration, changing account permissions, or notifying B.O.M. in writing. Revoking access may limit or prevent participation in coaching tiers that require wearable data.

WHOOP and other wearable providers are independent third parties. Their products, subscriptions, APIs, account settings, data availability, privacy practices, terms, and security are controlled by them, not by B.O.M.

5. Portal Data and Sensitive Health-Related Information

The B.O.M. Portal may store personal information, training data, nutrition data, wearable data, progress information, coaching communications, and other health-related information. B.O.M. may also receive sensitive information outside the portal through email, secure upload link, encrypted transfer, forms, screenshots, or other approved communication methods.

B.O.M. treats this information as confidential and sensitive. However, no website, portal, email account, file transfer method, or digital storage system can be guaranteed completely secure.

6. Electronic Communications

By communicating electronically with B.O.M., you understand that email, text, file transfer, screenshots, attachments, and other digital communications may carry privacy and security risks. These risks include unauthorized access, misdirected messages, device loss, account compromise, and service provider failures.

Do not send sensitive health-related information unless you understand these risks and have signed the required B.O.M. consent forms.

7. How We Share Information

We do not sell your personal information, bloodwork, wearable data, progress photos, private coaching communications, or sensitive health-related information.

We may share information only as needed with:

  • service providers that help operate the website, portal, databases, hosting, email, document signing, scheduling, payments, analytics, security, communications, or coaching systems;
  • professional advisors such as attorneys, accountants, insurers, or compliance advisors;
  • emergency contacts or emergency services if necessary for safety;
  • authorities, regulators, courts, or other parties when required by law or to protect rights, safety, security, or legal interests;
  • third parties with your separate written consent or direction.

B.O.M. will not use your lab results, wearable data, progress photos, private health information, or private coaching communications in public marketing without separate written consent.

8. Third-Party Services

B.O.M. may use or reference third-party services, including but not limited to WHOOP, Marek Diagnostics, Quest Diagnostics, payment processors, email providers, hosting providers, database providers, analytics tools, scheduling tools, document signing tools, file transfer tools, and communication platforms.

These third parties are independent from B.O.M. and may have their own terms, privacy policies, security practices, data retention practices, pricing, features, availability, and support processes. B.O.M. is not responsible for third-party outages, errors, data inaccuracies, billing issues, product changes, privacy practices, or service availability.

9. AI, Automation, and Data Tools

B.O.M. may use software, analytics, automation, and data tools to organize workouts, generate reports, review trends, improve coaching operations, and support the client experience.

B.O.M. will not intentionally submit identifiable bloodwork, wearable data, progress photos, private health-related information, or private client communications to external AI tools for model training or unrelated purposes without separate consent or appropriate de-identification.

10. Security

B.O.M. uses reasonable administrative, technical, and physical safeguards to protect information. These may include account access controls, password protection, two-factor authentication where available, restricted access, secure hosting, encrypted connections, and limiting access to information based on operational need.

No system is completely secure. You are responsible for using secure devices, protecting your account credentials, not sharing your portal login, and notifying B.O.M. promptly if you suspect unauthorized access.

11. Data Retention

We retain information for as long as reasonably necessary to provide services, operate the business, maintain coaching records, comply with legal/tax/accounting obligations, resolve disputes, enforce agreements, protect security, and support legitimate business purposes.

You may request deletion, correction, access, limitation, or disconnection of certain information by contacting B.O.M. Some information may be retained when required for legal, business, accounting, security, backup, dispute, or operational reasons. Third-party services may retain information according to their own policies.

12. Your Choices and Requests

Depending on your location and applicable law, you may have rights to request access, correction, deletion, portability, limitation, or information about how your personal information is used or shared.

You may also:

  • disconnect wearable integrations;
  • stop sharing certain information;
  • request deletion of certain files or records;
  • unsubscribe from non-essential marketing communications;
  • request that B.O.M. no longer use certain data for coaching decisions, understanding this may limit or prevent participation in certain services.

13. State Privacy Rights

Certain U.S. states may provide specific rights regarding personal information or sensitive personal information, including health-related information. If applicable, B.O.M. will respond to verified requests consistent with applicable law.

B.O.M. does not sell sensitive health-related information. B.O.M. does not use client lab results, wearable data, progress photos, or private coaching communications in public marketing without separate written consent.

14. Health Information and HIPAA Note

B.O.M. is a fitness coaching business, not a medical practice. Unless explicitly stated in a separate written agreement, B.O.M. is not acting as a HIPAA covered entity or business associate. Information you share with B.O.M. may be sensitive health-related information, but B.O.M. coaching is not medical care and does not create a physician-patient relationship.

You should not use B.O.M. coaching, portal output, wearable metrics, or training recommendations as a substitute for medical advice, diagnosis, treatment, physical therapy, medical nutrition therapy, or emergency care.

15. Children and Minors

B.O.M. services are not intended for children under 13. Minors may participate only with parent or legal guardian consent and any required additional documentation.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we update it, we will revise the "Last updated" date. Continued use of the website, portal, or services after changes are posted means you acknowledge the updated policy.
